2025 FLSA Overtime Statement

Federal legislation enacted in 2025 (the One Big Beautiful Bill Act) created a provision that allows employees, if eligible, to deduct the premium portion of qualified Fair Labor Standards Act (FLSA) overtime compensation on their federal income tax return.

Why this information is not on your 2025 Form W-2

Because the law was enacted mid-year, the IRS did not update Form W-2 for tax year 2025 and designated the year as a transition (“hold harmless”) year. The IRS has stated that employers may, but are not required to, provide supplemental information to employees.  Consistent with this guidance, Auburn School District did not separately report qualified overtime premium amounts on the 2025 Form W-2.

What qualifies as FLSA overtime premium pay

● Only the overtime premium required under the FLSA is considered qualified. This generally equals the additional one-half (.5) paid above an employee’s regular rate for hours worked over the FLSA overtime threshold.

● When overtime is paid at more than time-and-a-half (such as double time), only the portion required under the FLSA is qualified; any additional premium pay is not eligible under this provision.

 Requesting an informational statement

Employees who received FLSA overtime compensation in 2025 may request an informational statement summarizing their qualified and non-qualified overtime premium pay. This statement is provided for employee information only, is not filed with the IRS, and does not replace Form W-2.

To request a statement, contact Payroll at payroll@auburn.wednet.edu.  Please allow 30 days for statement requests to be processed.

 Reminder

Auburn School District cannot provide tax advice or determine employee eligibility for any deduction.  Employees should retain any statement provided with their tax records and consult a tax professional or IRS guidance when preparing their return.
